Terms of Sale
- If you are using a credit card you agree that you are the cardholder
named on the card and you are 18 years of age or older.
- You agree to pay according to the terms of your card agreement and
according to our terms and conditions
- You understand that you are entering into a contract for goods and
services and that you agree to be bound by the conditions set forth
in our Warranty, Shipping Policy, Terms of Use and Art File Specifications
as shown on our website.
- Decoration orders are subject to a 20% cancellation charge. Decoration
orders include Printing, Transfer, Numbering, and Embroidery orders.
There is a grace period for cancellation of decoration orders. This
grace period is 24 hours from the time you place the order or whenever
we begin to work on the order. This means that if you place the order
at 10AM on Monday and we do proofs by 1PM on Monday that a cancellation
charge applies even though only 3 hours has elapsed. When you place
an order we begin to work on it almost immediately. Each of our departments
reviews the order and begins activities that are geared toward completing
your order in a timely manner. When you cancel an order we incur real
monetary damages related to your failure to complete the transaction.
Had you not placed the order and cancelled it we could have helped
another customer.
- You have ownership or rights to print the design you are ordering
printing for. You agree to be held soley liable for infringement actions
brought as a result of your printing order. You agree to indemnify
Texas Shirt Company in all damages, attorney fees, court costs, and
other associated costs in the event that you do not have ownership
or copy rights to a mark, work, or other art that you submit. Your
lack of legal rights to a design will not exempt you from liability
for a cancellation charge should we discover such lack of rights and
terminate your order to protect ourselves.
- Please be sure you shirt order is exactly what you want. Once the
order is placed there is a change fee that will apply. This ranges
from $5 to $20 per change. The change fee only applies to changes to
the shirt size, type, style, or color. It applies to any change in
quantity, color, size, style whether the change is addition, removal,
or substitution. Any change to a shirt line item is subject to a change
fee.
- In the event that we extend payment terms to you, we may revoke such
terms at any time.
- In the event that you become delinquent on your account we may hold
any merchandise we are in possession of until the account is satisfied.
- In the event that such delinquency continues, we may initiate colleciton
proceedings and you agree to pay the full cost of such collections
activities including, collection agency fees, lawyers fees, and court
costs.
- In the event that we store items for you, you agree that we may charge
a storage charge of $5 per week and $1 per box.
- By completing this order you agree that you have read our returns
policy.
- You agree that Texas Shirt Company will be liable only to the amount
of the invoice for your order. This limit will include late, missing,
damaged, defective, unsaleable, or just plain wrong merchandise. This
will include items that we supply and items you supply. In no case
will the liability you seek exceed the amount you were billed, charged,
and invoiced.
- In the event of a dispute, you agree to waive your right to a jury
trial and a trial by judge and agree to submit to binding arbitration
in Houston, Harris County, Texas. Such arbitration will be via a recognized
arbitration forum of Texas Shirt Company's choice or your choice with
our consent. Arbitration may be conducted via the Better Business Bureau
arbitration and dispute resolution service as well. Should you disagree
with this clause you must immediately inform Texas Shirt Company and
we have the right to cancel your order without recourse. We believe
arbitration to be an equitable and legal substitute for a court of
law that respects the interests of both parties and resolves issues
faster and at reduced cost to all parties involved. Texas Shirt Company
must acknowledge your objection in writing and consent to such change
in our terms for it to be binding. Unacknowledged notices are considered
not to have been received.
